Notice of claimed infringement
To help us evaluate a request promptly, a written notice should include:
- a physical or electronic signature of the copyright owner or a person authorized to act for the owner;
- identification of the copyrighted work claimed to be infringed, or a representative list when one notice covers multiple works;
- identification of the allegedly infringing material and enough information, such as the exact page URL, for us to locate it;
- your name, mailing address, telephone number, and email address;
- a statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
- a statement that the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act for the owner.
Only the copyright owner or an authorized representative should send a takedown notice. Questions about a listing's price, status, attribution, or other factual data that do not allege copyright infringement should be sent to annadementov@gmail.com.
What happens after a complete notice
We may remove or disable access to identified material while we evaluate a complete notice. When appropriate, we may notify the person or source that supplied the material and provide information about a counter-notice. Notices involving licensed listing content will be routed to the applicable data provider within the period required by the operator's license and MLS rules.
Counter-notice
A person whose material was removed or disabled because of a copyright notice may send the designated agent a written counter-notice containing:
- the person's physical or electronic signature;
- identification of the removed material and the location where it appeared before removal;
- a statement under penalty of perjury that the person has a good-faith belief the material was removed or disabled because of mistake or misidentification;
- the person's name, address, and telephone number; and
- consent to the jurisdiction of the appropriate federal district court and acceptance of service of process from the party who sent the original notice, as required by 17 U.S.C. § 512(g).
If we receive a valid counter-notice, we may restore the material as permitted by law unless the original claimant timely notifies us that it has filed a court action seeking to restrain the disputed activity.
Misrepresentation and repeat infringement
Knowingly misrepresenting that material is infringing, or that removed material was removed by mistake, may result in liability. Where applicable, we may terminate access for users who repeatedly infringe copyrights in appropriate circumstances.
Required IDX provider notice
The Digital Millennium Copyright Act of 1998, 17 U.S.C. § 512 (the “DMCA”) provides recourse for copyright owners who believe that material appearing on the Internet infringes their rights under U.S. copyright law. If you believe in good faith that any content or material made available in connection with our website or services infringes your copyright, you (or your agent) may send us a notice requesting that the content or material be removed, or access to it blocked. Notices must be sent in writing by email to: annadementov@gmail.com.
The DMCA requires that your notice of alleged copyright infringement include the following information: (1) description of the copyrighted work that is the subject of claimed infringement; (2) description of the alleged infringing content and information sufficient to permit us to locate the content; (3) contact information for you, including your address, telephone number and email address; (4) a statement by you that you have a good faith belief that the content in the manner complained of is not authorized by the copyright owner, or its agent, or by the operation of any law; (5) a statement by you, signed under penalty of perjury, that the information in the notification is accurate and that you have the authority to enforce the copyrights that are claimed to be infringed; and (6) a physical or electronic signature of the copyright owner or a person authorized to act on the copyright owner's behalf. Failure to include all of the above information may result in the delay of the processing of your complaint.
When IDX is enabled, any DMCA notice received by the operator or its vendor must also be reported to MLS GRID at DMCAnotice@MLSGrid.com no later than 24 hours after receipt.
